The failure of Taiwan\u2019s pro-LGBT referendum does not represent the end of the marriage equality and LGBT movement \u2013 we need to rebuild a fighting LGBT movement against further attacks<\/strong><\/p>\n\n\n\n\n\n\n\n

The victory of the anti-LGBT referendum in November,\nby a large margin, was a blow to the struggle for marriage equality in Taiwan.\nTaiwan\u2019s LGBT movement, seen as a pioneering force across the Asian continent,\nnow faces a serious test.<\/p>\n\n\n\n

Five referendums were held on November 24, 2018, in\nconjunction with local and regional elections. This included anti- and pro-LGBT\nreferendums. The main propositions of the anti-LGBT referendum were: the civil\ncode can only recognise marriage between members of the opposite sex; gender\nequity education to be removed from primary and secondary schools; limitation\nof homosexual partnership with a discriminatory special law.<\/p>\n\n\n\n

Special law<\/strong><\/p>\n\n\n\n

The far-right anti-LGBT forces who were behind this\nreferendum blame social problems, like low birth rate, on LGBT communities,\nmaking them a scapegoat for the current social crisis, in order to cover up the\nreal causes of crisis: capitalist political parties and capitalism.<\/p>\n\n\n\n

The anti-LGBT referendum got 7.04 million yes votes,\ncompared to 3.44 million for the pro-LGBT referendum. On the following day,\nTaiwan\u2019s government announced it would draw up a special law giving same sex\nmarriage a separate status outside of existing marriage laws. With the success\nof their referendum the anti-LGBT forces have launched further attacks,\nopposing any recognition of same sex \u201cmarriage\u201d but only \u201cpartnership\u201d.\nAccording to law, partnership confers fewer rights than marriage, and this new\ndemand of the anti-LGBT forces is unconstitutional. If successful, it would\namount to legislating the discrimination of LGBT people. <\/p>\n\n\n\n

The ruling Democratic Progressive Party (DPP), which\nwas elected in 2016 on a promise to legalise same sex marriage, is under pressure\nfrom the anti-LGBT forces, but it also fears that if it pushes for the special\nlaw immediately, it will completely alienate the pro-LGBT people and face an\neven bigger loss of support at the general election next year.<\/p>\n\n\n\n

After the referendum, pro-LGBT legislators from the\nDPP and the leadership of the mainstream LGBT movement have further bowed to\nthe pressure from anti-LGBT forces, abandoning their previous demand to amend\nthe civil code in order to recognise same sex marriage. They excuse this\nretreat citing \u201clack of public support\u201d, betraying the three million voters who\nsupported marriage equality. In fact the movement\u2019s leadership is shifting\nblame from their own failings onto the masses. In the face of further attacks,\nthe retreat of the movement\u2019s leadership can further encourage the anti-LGBT\nforces and conservative ideas, with the result that the movement could suffer\neven bigger blows.<\/p>\n\n\n\n

The failure of pro-LGBT referendum does not represent\nthe end of the marriage equality and LGBT movement. Now we need to re-build a\nfighting LGBT movement against more attacks. With a correct strategy and\nperspective the movement can overturn the current upsurge of anti-LGBT forces.<\/p>\n\n\n\n

As International Socialist Forward (ISF) has stressed\nall the time, referendums under capitalism are far from democratic, because the\nvoice of progressive youth and workers is usually drowned out by the\ncapitalists and their agents with lots of money and control of corporate media.\nOnly through mass struggle, mounting a direct challenge against anti-LGBT\npoliticians and religious forces, and showing a political alternative, can the\nLGBT movement win.<\/p>\n\n\n\n

Big<\/strong> business backing<\/strong><\/p>\n\n\n\n

The anti-LGBT religious forces have got lots of\nsupport from big business and establishment politicians, who provide large\namount of resources for them, with which they conduct a scaremongering campaign\nand stir up prejudice and discrimination. This is one of the reasons they won\nthis undemocratic referendum. According to a report by Apple Daily, the\nfoundations set up by Wang Hongxue, the chairwoman of HTC, a multinational\nelectronics company based in Taiwan, have provided NT$900 million (around US$30\nmillion) for anti-LGBT religious organisations and activities in recent\nyears. <\/p>\n\n\n\n

A \u2018charitable trust\u2019 set up by Formosa Plastics, the\nbiggest private business in Taiwan, once gave Wang\u2019s foundations NT$300 million\nfor arranging anti-LGBT \u2018courses\u2019. The anti-LGBT forces have also spent huge\nfunds on advertising in the media, streets, and even in schools and\nuniversities, defaming LGBT and same-sex marriage and inciting homophobia. In\naddition, they can mobilise a section of voters through religious structures.<\/p>\n\n\n\n

Moreover, the referendum law is extremely unfair to\nyouth and the working class, not allowing migrants to vote in the constituencies\nwhere they live, which undermines the turnout among young people and workers\nwho leave their hometown for education or work. It is shown by experiences in\nother countries that young people and workers are the main forces for the\nsuccess of the LGBT movement. Therefore, the structure of this undemocratic\nreferendum was inherently disadvantageous to the marriage equality movement.<\/p>\n\n\n\n

Nevertheless, in our opinion the pro-LGBT referendum\ncould have won. In the period for collecting signatures, 500,000 signatures\nwere gathered within a month, showing the enthusiastic support for this idea\namong workers and youth in particular. (The referendum law stipulates that only\nwhen signatures from 1.5 percent \u2013 around 280,000 \u2013 of total eligible voters\nare collected in half a year, can a referendum be held). <\/p>\n\n\n\n

Although the funds raised by the movement were much\nsmaller than anti-LGBT forces and only hundreds of activists went onto the\nstreets for canvassing, the pro-LGBT referendum got three million yes votes.\nThese results show that the movement has huge potential. If the leadership of\nthe movement had mobilised and organised the supporters who were not active in\nthe movement, the movement could have had enough power to defeat the anti-LGBT\nforces.<\/p>\n\n\n\n

Unfortunately, the leadership deliberately\nde-politicised the movement and refused to challenge the anti-LGBT forces and\nbig business standing behind them. They peddled the illusion that marriage\nequality is only a \u201clegal issue\u201d, downplaying its political nature and the\nvital role of mass struggle. Moreover, they more than once intervened to\ndemobilise the movement, such as asking grassroots activists to \u201cwait\u201d for the\nreferendum after having collected enough signatures. This approach dissipated\nthe power of the movement and gave space for the anti-LGBT forces\u2019 propaganda.\nAt the same time, the approach of organised mass struggle which ISF stands for\nis dismissed as \u201ctoo radical\u201d by the leadership of the mainstream LGBT\nmovement.<\/p>\n\n\n\n

Rebuild the movement<\/strong><\/p>\n\n\n\n

In order to defeat the government\u2019s special law and\nfurther attacks from the anti-LGBT forces, and to rebuild an LGBT movement\npowerful enough to win marriage equality, the movement needs new methods, that\nis, a mass movement based on democratic grassroots organisations and struggle\nagainst the conservative, undemocratic rule of the capitalist parties and big\nbusiness. Therefore, this movement must link up with an anti-capitalist working\nclass movement, which has the strongest power to change the society.<\/p>\n\n\n\n

In the first half of 2018, ISF strived to link the\npro-LGBT referendum to the referendum against the neo-liberal labour law\nreform. We pointed out that united struggles against the anti-LGBT forces could\nhelp unite the working class, while on the other hand, only the united\nstruggles of working class people against capitalism can provide everyone with\nthe material resources necessary for real marriage equality and provide enough\nresources for gender equity education under a publicly-owned and controlled\nschools system. In order to reach these goals, we need to break the control of\nthe capitalists over social wealth, and replace the patriarchal capitalist\nsystem and the dictatorship of big business with democratic socialist public\nownership and economic planning.<\/p>\n","protected":false},"excerpt":{"rendered":"
