The\u00a0district\u00a0court delivered a guilty verdict against employer Law Wan-tung for beating, starving and abusing Indonesia domestic worker Erwiana Sulistyaningsih over an eight month period. Law was found guilty of 18 of the 20 charges laid against her. This was described as a \u201clandmark case\u201d by\u00a0news media worldwide including Time magazine. Erwiana\u2019s ordeal \u201csparked global outrage\u201d noted The Telegraph (UK).<\/p>\n<p>\u201cI hope they will start treating migrant workers as workers and human beings, and stop treating us like slaves,\u201d Erwiana said at the end of the six-week trial.<\/p>\n<p><strong>Mass protests<\/strong><\/p>\n<p>It is clear that the protests by thousands of domestic workers in Hong Kong, including a succession of colourful street marches, have won widespread sympathy from other sections of society and put the authorities \u2013 including the courts \u2013 under pressure by\u00a0exposing the city\u2019s unjust employment system for migrant domestic workers which leaves them prone to physical abuse and violations of basic rights.<\/p>\n<p>\u201cWe are very inspired by this victory. We will make use of it to further our struggle for domestic workers\u2019 rights,\u201d Eman Villanueva from the Asian Migrant Coordinating Body told chinaworker.info.<\/p>\n<p>Many agree it is essential the pressure is increased upon the Hong Kong government.<\/p>\n<p>\u201cThis welcome guilty verdict doesn\u2019t unfortunately change the government\u2019s policies which racially discriminate against migrant domestic workers,\u201d said Sally Tang Mei-ching of Socialist Action. \u201cHong Kong laws like the \u2018live-in rule\u2019 and \u2018two-week rule\u2019 are like the former apartheid system in South Africa \u2013 designed to segregate and control a particular group of workers who are super-exploited.\u201d<\/p>\n<p>Amnesty International issued a statement saying, \u201cThe guilty verdict is a damning indictment of the government\u2019s failure to reform the system that traps women in a cycle of abuse and exploitation.\u201d In 2013, Amnesty condemned the \u201cslavery-like\u201d conditions faced by Indonesian migrant workers and accused the Hong Kong government of \u201cinexcusable\u201d inaction.<\/p>\n<p>Eman Villanueva is very clear that the mass protests by domestic workers in Hong Kong have played a key role. \u201cWithout the movement, the government would have just ignored the case \u2013 it is the movement that made Erwiana\u2019s case known to everyone in Hong Kong and the international community so the government and the court were forced to take action.\u201d<\/p>\n<figure id=\"attachment_9323\" aria-describedby=\"caption-attachment-9323\" style=\"width: 600px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/media.chinaworker.info\/2015\/02\/650x432xErwiana-Sulistyaningsih1.jpg.pagespeed.ic_.p0H6biPJOBgeZsmjPWrY-e1423592779623.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-9323\" src=\"http:\/\/media.chinaworker.info\/2015\/02\/650x432xErwiana-Sulistyaningsih1.jpg.pagespeed.ic_.p0H6biPJOBgeZsmjPWrY-600x399.jpg\" alt=\"Erwiana was held as &quot;a prisoner&quot; said the judge.\" width=\"600\" height=\"399\" \/><\/a><figcaption id=\"caption-attachment-9323\" class=\"wp-caption-text\">Erwiana was held as &#8220;a prisoner&#8221; said the judge.<\/figcaption><\/figure>\n<p><strong>\u201cA prisoner\u201d<\/strong><\/p>\n<p>The court heard of the horrific treatment suffered by Erwiana at the hands of her employer. She was punched in the face so her teeth broke and a vacuum cleaner tube was forced into her mouth causing her lips to bleed. She was starved \u2013 fed nothing but meagre portions of bread and rice \u2013 and allowed only four hours sleep each night.<\/p>\n<p>Erwiana became a \u201cprisoner\u201d of Law Wan-tung, in the words of Judge Amanda Woodcock. Law threatened to have Erwiana\u2019s family killed if she ever reported the abuse. Prosecutors said she was treated as an \u201cunpaid slave\u201d \u2013 Erwiana never received any salary from Law, who was also ordered to pay HK$28,000 in unpaid salary.<\/p>\n<p>Around 320,000 foreign domestic workers, sometimes called \u2018helpers\u2019, live and work in Hong Kong. Half come from the Philippines and almost as many from Indonesia. In recent years they have become a growing force with high profile protests to demand reform of the unjust employment laws and action against the recruitment agencies that routinely break the law by overcharging workers and forcing them into a form of debt slavery.<\/p>\n<p><strong>Abolish the \u2018live-in rule\u2019<\/strong><\/p>\n<p>Migrant domestic workers are forced by law under the so-called \u2018live-in rule\u2019 to live in their employer\u2019s home. This law has no purpose other than as a tool of social control \u2013 to prevent migrants living independently and putting down social roots in the city which would increase their economic bargaining power. The \u2018live-in rule\u2019 robs them of privacy while also reinforcing their vulnerability to the power of the employer who is also the \u2018landlord\u2019. Living at their place of work inevitably makes the work day harder to regulate and pressures domestic workers into working excessively long hours. Amnesty\u2019s survey found that Indonesian migrants worked an average 17-hour day in Hong Kong.<\/p>\n<p>Indirectly this miserable state of affairs was recognised by Judge Woodcock in her summary: \u201cShe [Erwiana] was, for want of a better word, a prisoner in those premises\u2026 She was completely isolated, and [this] helps explain why this abuse could go on for so long without her retaliating or anyone knowing.\u201d<\/p>\n<p>While abuse and violence on the scale suffered by Erwiana are not typical, the isolation described by the judge is a reality for many\u00a0domestic workers in Hong Kong. The judge\u2019s comments are therefore a powerful argument for abolishing the \u2018live-in rule\u2019. But instead the Hong Kong government is strengthening the enforcement\u00a0of this law, with a police crackdown initiated some weeks ago including dawn raids against migrant workers accused of living outside their employers\u2019 premises.<\/p>\n<p>\u201cIf the Hong Kong government insists on its existing policy, there will be even more \u2018Erwianas\u2019 \u2013 more abuse on migrant workers,\u201d said Eman Villanueva.<\/p>\n<p>The hypocrisy of the Hong Kong government knows no bounds. Secretary of Labour and Welfare Mathew Cheung Kin-chung \u201cwelcomed\u201d the court\u2019s ruling in the Erwiana case. \u201cThis underlines the importance that the government and the court attach to protecting the labour rights as well as the well-being of foreign domestic helpers in Hong Kong,\u201d he said.<\/p>\n<p>Workers cannot expect any \u201cprotection\u201d from the Hong Kong government which only protects the interests of the billionaires.
